1. Definitions

In these terms, the following definitions apply:

• "We / Us / Our" means Pebblehearth, a service provider based at 14 Jalan SS 2/61, 47300 Petaling Jaya, Selangor, Malaysia.
• "User / You" means any individual accessing this website or engaging our services.
• "Services" means the estate documentation and heritage archival services we offer, including the Estate Document Locator Map, the Heirloom Storage Survey, and the Multigenerational Memory Project.
• "Agreement" means these Terms and Conditions together with any booking confirmation or engagement letter.
• "Output" means any written document, survey, or printed material produced and delivered to you as a result of a Service engagement.

2. Acceptance of Terms

By using this website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree, you should not use this website or proceed with a booking.

Our services are available to individuals aged 18 years and above. By submitting an enquiry or booking a service, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

3. Service Description

We provide administrative and archival support services for households. These services are informational and organisational in nature. They do not constitute legal advice, financial advice, professional appraisal, insurance guidance, or any form of licensed professional service.

Services are currently available to households located within the Klang Valley area of Selangor and Kuala Lumpur. Enquiries from outside this area will be assessed on a case-by-case basis.

4. Service-Specific Terms

4.1 Estate Document Locator Map

This service consists of a single visit of approximately two hours, followed by delivery of a one-page written document map and a labelled folder index. The practitioner will note the location of documents as observed; no documents will be moved, removed, or interpreted. Delivery of the written output will occur within five working days of the visit unless otherwise agreed.

4.2 Heirloom Storage Survey

This service consists of two visits. Photographs taken during the survey are used solely for the purpose of producing the written output and will be deleted within 30 days of the client accepting the final report. No appraisal of monetary value is offered or implied.

4.3 Multigenerational Memory Project

This service runs over four calendar months with regular monthly visits. Audio recordings are made with your explicit consent and are transferred to you upon project completion; all copies held by Pebblehearth will be deleted within 30 days of project completion. All original documents and photographs remain with you throughout and at the end of the engagement. The final memory book is printed once reviewed and accepted by you.

5. Booking and Payment

Service fees as at the date of booking are:

• Estate Document Locator Map: RM 460
• Heirloom Storage Survey: RM 1,360
• Multigenerational Memory Project: RM 4,560 (instalment arrangement available)

All fees are quoted in Malaysian Ringgit (MYR) and are inclusive of applicable taxes. Payment terms will be confirmed in writing at the point of booking. We accept bank transfer and common Malaysian digital payment methods. Fees are non-refundable once a visit has been conducted, except in cases of error or failure on our part to deliver the agreed output.

6. Cancellation and Rescheduling

You may reschedule a visit with at least 48 hours' notice at no additional charge. Cancellations made less than 24 hours before a scheduled visit may be subject to a rescheduling fee. We will notify you as early as possible if we need to reschedule for reasons on our side.

7. Intellectual Property

All written outputs produced by Pebblehearth and delivered to you as part of an engagement are for your personal household use. You may reproduce them for your own family's administrative purposes. You may not resell, publish, or distribute them commercially without our written consent.

The content of this website — including text, structure, and design — is the property of Pebblehearth and may not be reproduced without permission.

8. Confidentiality

We treat all information observed, recorded, or noted during service visits as confidential to your household. We will not disclose this information to third parties except as required by law or with your explicit consent.

9. Disclaimers

Our services are administrative and archival in nature. We do not provide legal, financial, medical, or professional advisory services of any kind. Nothing in our outputs constitutes professional advice, and we accept no responsibility for decisions made on the basis of information contained in any output we produce.

We make reasonable efforts to ensure accuracy in our written outputs, but we cannot warrant that every document location or storage observation is complete. We rely on information available and observable at the time of the visit.

10. Limitation of Liability

To the maximum extent permitted under Malaysian law, our total liability to you in connection with any service engagement is limited to the fee paid for that engagement. We are not liable for indirect, consequential, or special losses arising from our services or their outputs.

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including access restrictions to the property or unavailability of the household members needed to complete the engagement.

11. Indemnification

You agree to indemnify and hold Pebblehearth harmless from any claims, losses, or damages arising from your misuse of our outputs, your breach of these terms, or your provision of false or misleading information in connection with a booking.

12. Termination

Either party may terminate an ongoing engagement by providing written notice. If you terminate after a visit has been conducted, the fee for that visit remains payable. If we terminate due to circumstances on our side, we will refund any fees paid for work not yet completed.

13. Dispute Resolution

We encourage informal resolution of any disputes. If you have a concern, contact us at [email protected] and we will respond within ten working days.

These Terms are governed by the laws of Malaysia. Any disputes that cannot be resolved informally shall be subject to the non-exclusive jurisdiction of the courts of Malaysia.

14. General Provisions

• Entire agreement: These terms, together with any booking confirmation, constitute the entire agreement between the parties.
• Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
• Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement.
• Assignment: You may not assign your rights under these terms without our written consent.

15. Changes to These Terms

We may update these terms from time to time. When we do, the "Last Updated" date will change. Continued use of this website or our services following any update constitutes acceptance of the revised terms.
